Divorce by Mutual Consent

While the end of any relationship is a tragedy, the legal process of a divorce can be particularly traumatic for all parties involved. In this process, rather than the year-long process of arguing the causes of a divorce and the allocation of resources and custody, both parties come to an understanding and present it to the court jointly.

However, while it is less lengthy and painful than a contested divorce, engaging in a mutual consent divorce is an involved process. It requires in-depth negotiation between the parties as to the disposition of assets and arrangements of custody and alimony. These terms must then be incorporated in a series of legal documents – including a separation agreement, the joint petition before the court, and transfer deeds for any property transferred through mutual agreement.
