If a marriage fails, often one spouse will know before the other. In these circumstances, one spouse will seek the dissolution of the marriage while the other tries to hold it together. Even where both spouses agree to the dissolution of the marriage, they may not arrive at an agreement as to the terms of the divorce – such as alimony, distribution of property, custody or child support. In either of these two circumstances, the only recourse left is the court through a contested divorce. Unlike the relatively straightforward process of mutual consent divorces, contested divorces are among the most involved of court proceedings. The process is complex, involving multiple court appearances and many more motions filed.
