When it comes to a family separating into two, the most significant and extraordinarily sensitive matter is custody. This isn’t merely an issue in divorce – it also applies when the parents of the child are not married or there are different godparents/caretakers of the child. The custody dispute occurs when the parents or caretaker of the child disagree on the child custody arrangement. This includes where the child will live, who will take the decisions in the child’s life, visitation rights and other intricate details relating to the child’s care and interaction with the guardians/parents.

Often child custody disputes require the intervention of the court where the judicial involvement depends on the cooperation between the parties. If the parties can formulate a child custody arrangement, the same can be presented to the judge for approval. However, if the parties are unable to come to a consensus, judicial intervention will be required, and the court will decide the custody arrangement as a custody order. The custody orders are made solely for the child’s best interest. The child’s needs and abilities are taken into consideration to see who will make a fit guardian for the child and what kind of child support is required.
